1. Warranty against manufacturing defects
The Company guarantees its products against any manufacturing defect for a period of 12 months from the date of delivery of each product, unless otherwise stipulated in the contract.
2. Limitation of the Company's obligations
The Company's warranty is limited to the following actions, at its choice:
Repair,
Bringing into conformity,
Refund,
Free replacement.
These actions are limited to the initial quantity of products purchased and exclude any compensation or damages. The conditions for benefiting from this warranty are as follows:
Written notification by the Buyer to the Company during the warranty period.
Return of the defective product at the Buyer's expense to a location designated by the Company.
Confirmation by the Company, after inspection, of the existence of a manufacturing defect covered by the warranty.
3. Risks and transport costs
The Buyer assumes the risks and costs associated with the shipment of defective products. The Company shall bear the costs and risks associated with processing the warranty claim and returning the products to the Buyer's premises, provided that the inspection confirms the warranty coverage. Otherwise, all costs and risks shall be borne by the Buyer.
4. Warranty Exclusions
The Company's warranty does not apply to the following situations:
Consumable parts (e.g. containing fluids).
Defects resulting from the Buyer or a third party's failure to observe the conditions of use, storage, care and/or maintenance specified in the instructions provided by the Company.
Defects resulting from non-compliance with the rules of use or applicable standards.
Defects caused by specific instructions from the Buyer, or repairs/modifications carried out by the Buyer or a third party commissioned by the Buyer.
Defects due to the combination of the products with other equipment not approved by the Company.
Defects resulting from use or storage in extreme or abnormal conditions.
Defects resulting from accidents, disasters, incorrect installations, loads by unauthorized devices, computer attacks or cyberattacks, or any abnormal or unreasonable use.
All other warranties than those mentioned in 7.1 are explicitly excluded.
5. Liability of the Buyer
The Buyer acknowledges having received all the information necessary to make its decision and is solely responsible for:
The use of the products.
The choice of products, their compatibility with its installations, and their suitability for its needs.
The Company does not guarantee the suitability of the products for a particular use defined by the Buyer, nor their compatibility with the transformations or integrations envisaged by the Buyer, unless otherwise stipulated.
6. Compliance with suppliers
The Company's warranty conditions are consistent with those granted by its suppliers. Replacement of defective parts or repairs are carried out under the conditions stipulated above.
7. Costs not covered by the warranty
The warranty does not cover:
Assembly, disassembly and travel costs.
Breakdowns resulting from improper use, negligence or lack of supervision.
